1. INFORMATION FOR THE USER

Who is responsible for the processing of your personal data?

LAMAIGNERE, S.L. is the CONTROLLER of the USER personal data processing and informs that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and the Organic Law 3/2018 of 5 December (LOPDGDD).

Which is the purpose of the processing of my personal data?

To maintain a commercial relationship with the user. The operations involved in the data processing are:

Submission of marketing publications by email, fax, SMS, MMS, social networks or any other electronic or physical medium, present or future, that permits commercial communications. Such communications will be made by the RESPONSIBLE and will be related to the products and services it offers and/or the products and services of its partners or suppliers with which the RESPONSIBLE may have reached an agreement for commercial promotion. In such case, third parties will never have access to personal data.

Performing of market researches and statistical studies.

Processing of orders, applications and request of any kind made by the USER via any of the forms of contact placed at the disposal of users on the RESPONSIBLE website.

Submission of the online newsletter about news, offers and promotions in our activity.

Reception, processing, management and storage of complaints.

Management of recruitment procedures.

Why can we process your personal data?

Because the processing is legitimized by the Art. 6 of the GDPR as follows:

Upon consent of the USER: submission of commercial communications and of the newsletter.

To satisfy a legitimate interest of the RESPONSIBLE: performing market researches, statistical studies and processing orders, applications or complaints from the USER.

Unambiguous consent through a clear action of the interested party: reception of CVs.

How long will we keep your personal data?

The data shall be kept for no longer than it is necessary for the purposes for which they were collected or further processed. As long as there are no legal prescriptions that dictate their custody, they will be suppressed with adequate security measures to guarantee the anonymization of the data or the total destruction of them.

Whom do we provide your personal data?

We may share the data with the group companies for the same purpose or by legal obligation. No communication of personal data to third parties is foreseen, except to the suppliers with which the RESPONSIBLE has signed the confidentiality and data processor contracts required by current privacy regulations if necessary for the development and execution of the purposes of the treatment.

What are your rights?

The USER has the following rights:

• Right to withdraw consent at any time.
• Right of access, rectification, portability and deletion of the data, and of limitation or opposition to its processing.
• Right to file a claim with the control authority (www.aepd.es) if the user considers that the treatment does not comply with current regulations.

2. COMPULSORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

When the USERS check the corresponding boxes and input data in the corresponding fields of the contact forms marked with an asterisk (*) are agreeing freely, unmistakably, and specifically to allow the handling of their data by the RESPONSIBLE to process the request. The input of data in the rest of the fields is optional. The USER guarantees that the personal data provided to the RESPONSIBLE are correct and is liable for notifying any change to them.

The RESPONSIBLE informs that all the data requested through the website are compulsory, since they are necessary for the provision of an optimal service to the USER. In the event that the USER do not provide all the data, it is not guaranteed that the information and services delivered fully meet USER’s needs.

3. SECURITY MEASURES

In accordance with the provisions of regulations in force on the subject of personal data protection, the RESPONSIBLE is complying with all provisions of GDPR regulations for the treatment of personal data under its responsibility and manifestly with the principles described in Art. 5 of GDPR by which data shall be fairly, lawfully and transparently processed in relation to the interested party and appropriate, relevant and limited to what is necessary in relation to the purpose for which they are processed. The RESPONSIBLE guarantees appropriate technical and organizational policies have been implemented to apply the security measures the GPDR and the LOPDGDD establish to protect the rights and freedoms of users and appropriate information has been communicated in order to USERS to be able to exercise them.
